Terms of Service for KSEFInvoices

1. Acceptance of Terms

By accessing, browsing, or using the KSEFInvoices website and application (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must immediately stop using the Service. Your continued use of KSEFInvoices constitutes legally binding acceptance of these terms.

2. Nature of the Service

KSEFInvoices provides a web-based tool for generating business documents (invoices). KSEFInvoices is not a tax advisor, accounting firm, or legal entity. We provide a technical tool for document formatting, not professional financial or legal advice.

3. User Responsibility and Accuracy (CRITICAL)

  • Data Entry: You are solely responsible for the accuracy and legality of all data entered into KSEFInvoices.
  • Calculation Verification: While KSEFInvoices includes automated calculation features, you are strictly required to verify all totals, VAT/tax amounts, and roundings before issuing an invoice. KSEFInvoices does not guarantee the mathematical or fiscal correctness of the generated output.
  • Review: You must review the final PDF or XML file to ensure it meets your specific business and legal requirements.

4. Government Portals and Regulatory Compliance (e.g., KSeF)

  • Rejection by Authorities: The Service allows you to generate files intended for use with government systems, such as the KSeF (Krajowy System e-Faktur) in Poland. However, KSEFInvoices does not guarantee that any file generated will be accepted by such portals.
  • Non-Liability for Rejection: KSEFInvoices shall not be held liable for any rejection of documents by tax authorities, local regulators, or government portals due to technical errors, schema mismatches, missing mandatory fields, or incorrect data.
  • Compliance: It is your responsibility to stay informed about the latest electronic invoicing standards in your jurisdiction.

5. Limitation of Liability and "As Is" Warranty

"As Is" Basis: KSEFInvoices is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties, express or implied.

No Damages: To the maximum extent permitted by law, KSEFInvoices and its creator shall not be liable for any direct, indirect, incidental, or consequential damages, including but not limited to:

  • Tax penalties or fines imposed by any authority.
  • Financial losses due to incorrect invoice data.
  • Business interruptions resulting from the use or inability to use the Service.
  • Loss of data stored in your browser’s LocalStorage.

6. Acceptable Use and Fraud Prevention

  • Lawful Use: You agree to use KSEFInvoices only for lawful business purposes.
  • Prohibited Activities: You are strictly prohibited from using the Service to generate fraudulent, forged, or misleading invoices. Any use of the Service for tax evasion or money laundering is a violation of these terms.
  • No Scraping: You may not attempt to reverse-engineer, scrape, or interfere with the technical operation of KSEFInvoices.

7. Data Persistence and User Environment Security

KSEFInvoices uses a "Privacy by Design" architecture. Your invoice data is stored exclusively in your browser's LocalStorage.

  • Local Environment Responsibility: You are solely responsible for the security of your device, browser, and local environment. This includes maintaining up-to-date anti-malware software and ensuring unauthorized persons do not have physical or digital access to your device.
  • No Liability for Local Breaches: KSEFInvoices shall not be held liable for any data theft, loss, or unauthorized access to your invoice data resulting from:
    • Malware, spyware, or viruses on your device.
    • Phishing, social engineering, or "fraud" targeting you as a user.
    • Unauthorized access to your browser or computer.
    • Browser extensions or third-party software with access to your LocalStorage.
  • No Cloud Recovery: We do not have access to your invoices and do not store backups on our servers. We cannot recover your data if it is stolen from your device or deleted during a "cleanup" of your browser.

8. Changes to Terms and Service

We reserve the right to modify these Terms or the Service itself at any time. Significant changes will be noted by updating the "Effective Date" at the top of this page.

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Poland. Any disputes arising from the use of KSEFInvoices shall be subject to the exclusive jurisdiction of the courts in Warsaw, Poland (or your current city of residence).
